Abstract

The settlement of criminal cases that still prioritize the principle of retributive justice where justice is achieved by punishing the perpetrator as a form of revenge is often unable to solve the problem holistically. The concept of restorative justice emerged as an alternative to resolving criminal cases. The formulation of the problem to be studied is how the comparison of restorative justice regulations in law enforcement agencies in Indonesia and whether there is a discrepancy with the restorative justice regulations between these law enforcement agencies. This study aims to determine the comparison of restorative justice regulations in law enforcement agencies in Indonesia and to determine whether there is a discrepancy with the restorative justice regulations between these law enforcement agencies. This study uses a normative juridical legal research method, with a descriptive research type. The results of this study are that among the three regulations of the law enforcement agencies, the regulation that best accommodates the restorative justice is Police Regulation Number 8 of 2021, and discrepancies were found between the three regulations of the law enforcement agencies. There needs to be a new legal policy that supports harmonization between law enforcement agencies so that the implementation of restorative justice is not only sectoral, but comprehensive and integrated from upstream to downstream.
