Abstract

There are three elements in criminal law enforcement, namely justice, legal certainty and benefit. In the proof greatly affects the three elements. Proof is a legal provision that regulates evidence that is legally recognized and can be used by judges to show someone's guilt. In the proof phase, the evidence submitted in court has its own strength and assessment. Evidence can determine the fate of the defendant and provide a sense of justice to the community and victims. In this study, the author will discuss the judge's considerations regarding the Visum et repertum evidence in a premeditated murder case that has been decided in decision NO. 204 / PID.B / 2023 / PN SKH.
