Abstract

Legal protection for trademark owners of unregistered goods in Indonesia has become important to understand as business practices and legal disputes related to intellectual property rights develop, as reflected in this case KEEN United States is facing a dispute related to a trademark that is considered to infringe on the trademark rights that have been registered, even though the goods in question are not registered in Indonesia. The formulation of the problem in this study is 1) How is the legal protection of trademark owners for unregistered goods based on the analysis of decision Number 556 K/Pdt.Sus-HKI/2016? 2) What is the basis for the judge's consideration in the decision of the District Court Number 556 K/Pdt.Sus-HKI/2016? The purpose of this study is to analyze the legal protection and the basis of judges' considerations in trademark disputes over unregistered goods based on the analysis of decision Number 556 K/Pdt.Sus-HKI/2016. The research method used is normative law with a legal approach (Statue Approach). The data sources used are primary and secondary legal sources. The results of this study show that: 1) In this dispute case, KEEN United States failed to obtain legal protection in Indonesia because the trademark was not registered when KEEN Indonesia registered its trademark in 2008. The "first to file" system in Indonesia prioritizes first registration, which prevents KEEN America from obtaining protection in the form of compensation claims. Furthermore, legal protection for unregistered trademark owners can be carried out through preventive measures including prevention of trademark registration that imitates well-known trademarks and trademark registration in several countries to ensure broader legal protection and repressive measures in the form of civil lawsuits or criminal channels to cancel trademarks that infringe on the rights of well-known trademark owners who have not yet been registered, as seen in decision Number 556 K/Pdt.Sus-HKI/2016. 2) The basis for the judge's consideration in the District Court Decision No. 556 K/Pdt.Sus-HKI/2016 related to the trademark cancellation lawsuit is that the lawsuit has passed the time limit stipulated in the Law, which is 5 years from the date of trademark registration. Thus, the lawsuit is considered expired.
