Abstract

Background: This research discusses the effectiveness of Police Regulation No. 8 of 2021 on Handling Crimes Based on Restorative Justice in resolving criminal cases and its benefits for the community in Pacitan Regency. The criminal justice system in Indonesia, including Pacitan District, is facing problems of case backlogs, lengthy processes, and large budget burdens. Police Regulation No. 8 of 2021 on Handling Crimes Based on Restorative Justice was issued as a solution, with a focus on timber theft cases in Pacitan. Methods: The researcher uses an empirical legal approach by combining primary data from the field and secondary data such as legal data to analyze the problem. In general, the research will be conducted in the jurisdiction of Pacitan Regency. The data that has been collected will be analyzed qualitatively. Results: The implementation of Police Regulation Number 8 of 2021 has succeeded in maintaining social harmony through deliberation in accordance with Pacitan's local wisdom. Case handling shifted from retaliation to restoring social balance and reconciliation. Police Regulation No. 8/2021 effectively fills the legal vacuum in the Criminal Code and KUHAP, bridging the conventional criminal justice system with the community's need for more effective, equitable and economical case resolution. The concept is in line with the principles of Islamic law.
