Abstract

Maternity and childbirth leave rights for female workers in Indonesia are a vital aspect of labor protection as stipulated in Law No. 13 of 2003 concerning Manpower. However, its implementation in practice often faces various challenges, such as potential violations of rights by companies and the lack of government oversight. This research aims to analyze the implementation of the law regarding maternity and childbirth leave rights, identify obstacles encountered in its application, and evaluate the Supreme Court Decision No. 1330 K/Pdt.Sus-PHI/2023 related to the provision of maternity leave. This study employs a normative juridical method with a descriptive-analytical approach. Data are obtained from document studies, including legislation, court decisions, and relevant legal literature. The analysis is conducted to illustrate the application of legal norms in practice and to evaluate their impact on the protection of female workers. The findings indicate that maternity and childbirth leave rights for female workers in Indonesia have not been fully implemented in accordance with the applicable legal provisions. Identified obstacles include the lack of regulatory dissemination to both workers and companies, weak government oversight, and low legal awareness among the public. Furthermore, the analysis of Supreme Court Decision No. 1330 K/Pdt.Sus-PHI/2023 highlights efforts in law enforcement that could serve as an important precedent for strengthening the protection of female workers' rights. This study recommends enhancing supervision by relevant agencies, intensifying regulatory dissemination to all stakeholders, and enforcing strict sanctions against violations. These measures are expected to promote the optimal implementation of maternity and childbirth leave rights, thereby supporting social justice and the protection of female workers in Indonesia.
