Abstract

The crime of drug abuse is regulated in Article 132 paragraph (1) Jo. Article 114 paragraph (2) of Law of the Republic of Indonesia Number 35 of 2009 concerning Narcotics and a review of Islamic law on drug abuse. Perpetrators of drug crimes are threatened with a sentence of 9 (nine) years and a fine of IDR 1,000,000,000 (one billion). This study uses a normative method. Data collection was carried out through literature studies taken from primary, secondary, and tertiary legal materials, then the analysis was carried out using a qualitative method, which was then presented descriptively. The results of the study on Court Decision Number 70/Pid.Sus/2024/PN Krg show that the Judge's considerations have a perspective of justice and an Islamic law perspective in dealing with drug crimes.Within the framework of positive law and Islamic law, this study is expected to assist in the creation of stronger legal regulations. It is hoped that this study can contribute to the development of more effective legal policies, both in the context of positive law and Islamic law. In addition, this research is also expected to be a reference for policy makers and legal practitioners in balancing repressive and rehabilitative approaches in handling drug abuse cases.
