Abstract
PT. Garudafood Putra Putri Jaya Tbk is a proud Indonesian manufacturing company that markets peanut products with a leading brand, namely Kacang Garuda, which currently produces and sells 5 (five) food and beverage brands, namely Garuda, Gery, Leo, Chocolatos, and Clevo. In carrying out its production activities, PT. Garudafood Putra Putri Jaya Tbk requires workers who are recruited based on the specified qualifications. This study aims to determine the work agreement process in carrying out work with a permanent system, regulations and rights and obligations, and legal responsibilities if one of the parties commits a violation in carrying out work with a permanent system. The approach method used is based on legal research, namely using a normative approach, because in this research what will be studied are legal principles, legal aspects, legal rules on legal responsibility between PT. Garudafood Putra Putri Jaya Tbk with workers in carrying out work with a fixed system. The research conducted is descriptive research, in which the data obtained from this research is expected to be able to describe clearly and in detail related to legal responsibilities between PT. Garudafood Putra Putri Jaya Tbk with workers in carrying out work with a fixed system. The results of the study stated that the work agreement process with a fixed system/unspecified time work agreement must meet the applicable laws and regulations, administrative requirements and legal requirements. The agreement occurs when both parties sign a work agreement with a fixed system/uncertain time work agreement made by PT. Garudafood Putra Putri Jaya Tbk and has been standardized. The agreement gave birth to a legal relationship between the two parties to carry out their rights and obligations. If one of the parties violates the work agreement with a permanent system, that is, does not fulfill its obligations, it must be responsible for default. If you violate the regulations that apply in the company, you must be responsible based on actions against the law.
