Abstract

Indonesia is a country that has a fairly dense population, causing population movement and population movement from region to region, so transportation is currently needed to facilitate the movement of people or goods. Land transportation which is one type of transportation in the transportation agreement which is an agreement by a transportation with passengers using land transportation. This study aims to determine the process of an online railroad carriage agreement, regulations and rights and obligations between PT. KAI by ferry, and Legal responsibility in the land carriage agreement between PT. KAI and ferries. The normative approach method, which is used to examine legal aspects, legal principles, legal rules relating to rail land transportation agreements. This type of research is descriptive because it describes and analyzes in a structured and comprehensive manner about the regulations that exist in the Legal Responsibility for rail land transportation online. The results of this study are that the online transportation agreement process is through the stages before the agreement occurs, the stage of the agreement and the stage after the agreement occurs. At the stage before an agreement occurs, you must meet the account registration requirements and the legal terms of the agreement. After fulfilling these conditions, the party welcomes the agreement that has been made by the carrier online. After the notification occurs, it is marked with an electronic signature and the acquisition of a ticket or E-boarding Pass. Therefore, the agreement between the parties creates a legal relationship in the form of rights and obligations between the parties. If one of the parties violates the online rail land transportation agreement due to an error in not fulfilling their obligations, it is said to be in default as stated in Article 1243 of the Civil Code and a violation of laws and regulations, morality and generality, it can be said to have committed an unlawful act based on Article 1365 of the Civil Code. If it is proven then he must compensate according to the applicable law.
