Abstract
Abstract The objectives of this research are: a) To find out the legal basis for the implementation of Fintech in Indonesia; b) To find out consumer protection for online loan losses or Illegal Fintech. This research is a juridical-normative research and the approach method used is the statutory approach, which is carried out by examining the rules and regulations related to the legal issues being handled. The result of the research obtained is that legal protection for lenders can be realized preventively based on Article 29 POJK Number 77 / POJK. 01/2016, namely by applying basic principles for Providers and repressive legal protection based on Article 37 POJK Number 77 / POJK. 01/2016 concerning Information Technology-Based Lending and Borrowing Services and Article 38 POJK Number 1/ POJK. 07/2013 concerning Consumer Protection in the Financial Services Sector, Providers are required to provide compensation to parties who are injured as a result of mistakes or negligence of the Fintech Organizer in terms of analyzing and selecting prospective Loan Recipients to be submitted to the Lender. In Indonesia, there are several institutions authorized to regulate the Fintech industry, namely: Bank Indonesia (BI); 1) Bank Indonesia Regulation Number 11/12 / PBI / 2009 which was amended to PBI Number 16/8 / PBI / 2014 and PBI Number 18/17 / PBI / 2016 concerning Electronic Money (PBI E-Money).2) Regulation of the Minister of Communication and Information Technology of the Republic of Indonesia Number 20 of 2016 concerning Protection of personal data in Electronic systems; 3) POJK Number 77 / POJK. 01/2016 concerning Information Technology-Based Lending and Borrowing Services and the last is the agreement regulated in the Civil Code.
