Abstract

This study aims to determine the validity of the sale and purchase agreement in e-commerce transactions and the good faith of the parties in transacting through e-commerce. The research method used is the normative legal research method. The type of research used is descriptive legal research. From the results of the research the validity of the sale and purchase agreement in e-commerce transactions and the good faith of the parties in transacting through e-commerce based on the Civil Code and Law Number 11 of 2008 concerning Electronic Information and Transactions. The conclusion from the research on the legal requirements of an agreement is that the provisions in Article 1320 of the Civil Code are mandatory and the rights and obligations of the parties have been carried out in good faith in transacting through e-commerce. The obstacle experienced is that it is difficult to know whether the parties are legally competent or not, not knowing the state of the object clearly
