Abstract

This study aims to determine the profile of the exoneration clause in the Madiun City PDAM standard agreement, namely in the New Subscription Application Form. This research explains the standard agreement and exoneration clauses contained in the New Subscription Application Form by method, then sets the New Subscription Application Form as a form of sale and purchase agreement based on its characteristics, outlining the rights and responsibilities of the parties in the agreement based on the Civil Code, then analyze the clause contained in the New Subscription Application Form is the exoneration clause or not. The clause used aims to shift the responsibility of business actors and this is detrimental to consumers. If it is based on existing provisions, namely Law no. 8 of 1999 concerning Consumer Protection, business actors are prohibited from including a clause stating that they transfer the responsibility of the business actor. Thus, in this study the authors write a problem formulation, namely how the profile of the exoneration clause contained in the Application Form for PDAM Madiun City New Subscription.
