Abstract

Catcalling is a form of verbal sexual harassment that frequently occurs in public spaces in Indonesia but is often normalized, resulting in inadequate legal protection for victims. The legal framework governing victim protection is regulated under several laws, including the Indonesian Criminal Code, the Human Rights Law, and Law Number 12 of 2022 concerning Sexual Violence Crimes, which serves as the most comprehensive legal instrument. This study aims to analyze legal policies on the protection of victims of verbal sexual harassment and to examine the application of the restorative justice approach in the recovery of catcalling victims. This research employs a normative legal research method using statutory and. The data consist of primary and secondary legal materials collected through library research and analyzed using descriptive normative methods. The findings indicate that although the existing legal framework provides a basis for victim protection, its implementation remains constrained by the general formulation of Article 5 of the Sexual Violence Crimes Law, the difficulty of proving catcalling cases, and the low reporting rate caused by social stigma. Initially, the restorative justice approach was considered capable of supporting victims' psychological, social, and material recovery. However, the enactment of Law Number 20 of 2025 concerning the Indonesian Code of Criminal Procedure excludes sexual violence crimes from restorative justice mechanisms. Therefore, restorative values should remain integrated into formal criminal proceedings through restitution, offender rehabilitation, and psychological assistance for victims to achieve victim-oriented legal protection.
