Abstract
The rapid growth of the local skincare industry in Indonesia, driven by the use of social media as a promotional tool, has expanded digital marketing practices. On the other hand, this situation has also given rise to the practice of conveying misleading advertising claims (overclaim) that have the potential to harm consumers. This practice is inconsistent with the principles of honesty, openness, and consumer protection as stipulated in Law Number 8 of 1999 concerning Consumer Protection, the Electronic Information and Transactions Law, and various provisions issued by the Food and Drug Monitoring Agency (BPOM). This study aims to examine the legal regulation regarding misleading advertising claims on local skincare products promoted through social media based on Indonesian laws and regulations, while also analyzing the forms of legal protection that can be provided to customers who suffer losses. The method used is normative (doctrinal) legal research with descriptive specifications. The research data obtained through literature studies and analyzed qualitatively using a deductive normative approach. The results show that legal provisions governing the prohibition of misleading advertising have been accommodated in the Consumer Protection Law (UUPK), the ITE Law and various BPOM regulations. Legal protection for consumers is realized through preventive measures such as supervision, guidance, education, and the formulation of regulatios, as well as repressive measures such as compensation, dispute resolution, and sanctions against business actors who commit violations. In views of this, it is necessary to strengthen inter-agency coordination, harmonize regulations, optimize the use of technology in digital monitoring, and increase public legal literacy so that consumer protection against misleading advertising practices in the digital can be implemented more effectively.
