Abstract
This study is motivated by the dominance of punitive approaches in resolving fraud and embezzlement cases, which have not fully restored victims’ losses. Restorative Justice emerges as an alternative approach that emphasizes recovery, offender accountability, and balance among the parties involved. However, its implementation in practice still faces various challenges. This study aims to analyze the application of Restorative Justice in handling fraud and embezzlement cases and to identify the obstacles encountered. This research employs a normative legal method with case and conceptual approaches. The data were obtained from statutory regulations, court decisions, and legal literature, and analyzed qualitatively. The results show that Restorative Justice has not been optimally implemented and remains limited in practice. Its application is only reflected in judicial considerations as mitigating factors, such as the offender’s confession and remorse. Moreover, the recovery of victims’ losses has not become the primary focus. The obstacles include juridical issues, judicial process constraints, conditions of victims and offenders, and the characteristics of the crimes. Thus, Restorative Justice still functions as a complementary approach and has not yet become the primary mechanism in resolving criminal cases.
