Abstract
The mechanism of supervision over judges in Indonesia and the Netherlands in maintaining the code of ethics for judges certainly faces several obstacles. The supervision of judges in Indonesia and the Netherlands is, of course, related to independence; to achieve judicial independence, in addition to that, the supervision of judges can also be viewed from the perspective of the principle of checks and balances. The supervision of judges is certainly related to the urgency of judicial independence in the justice system in Indonesia and the Netherlands. In Indonesia, the urgency of judicial independence has faced serious challenges regarding the effectiveness of institutions, especially in the coordination between the Supreme Court and the Judicial Commission. There is dualism in authority and a lack of continuity regarding ethical violations, which results in an imbalance in the supervision of judicial power. On the contrary, judicial oversight in the Netherlands has established an integrated monitoring system through the Council for the Judiciary and disciplinary boards, which is capable of carrying out ethical oversight functions without interfering with judicial substance. From the perspective of checks and balances, oversight of judges in Indonesia still does not reflect the principle of an ideal balance of power. The Judicial Commission, as a balancing institution, does not have strong enforcement powers over the Supreme Court, leading to an imbalance in the oversight of judicial power. On the contrary, the Netherlands applies checks and balances more functionally through independent yet accountable judicial oversight, allowing the justice system to maintain integrity without losing independence. This research uses a legislative approach and employs a quantitative research method aimed at understanding previous research methods. The results of the study show that although there are judges who violate the code of ethics, this is caused by several factors.
