Abstract

The rapid growth of the internet has driven the expansion of subscription-based video services, including Netflix. Alongside its popularity, the illegal sale of Netflix accounts has emerged on social media platform X and online marketplaces such as Shopee, Tokopedia, and Lazada at prices far below the official subscription rates. This practice causes financial and operational harm to Netflix and disregards multiple legal provisions applicable in Indonesia. This study aims to identify legal norms that can serve as the basis for legal protection for Netflix as a subscription-based video service provider against illegal account sales. The research employs a normative juridical approach using secondary data derived from primary, secondary, and tertiary legal materials. Data were collected through library research and analyzed using descriptive-analytical qualitative methods. The findings indicate that several legal instruments can serve as the basis for Netflix’s protection, including Articles 1239, 1242, and 1365 of the Civil Code; Articles 17, 38, and 39 of the ITE Law; Articles 1, 5, 8, and 10 of the Consumer Protection Law; Articles 83 and 100 of the Trademark Law; Articles 9, 40, and 95 of the Copyright Law; Articles 1 and 45 of Government Regulation No. 71 of 2019; Articles 1, 9, 13, and 15 of the Minister of Communication and Informatics Regulation No. 10 of 2021; Articles 1, 13, 28, and 29 of the Minister of Trade Regulation No. 31 of 2023; and Netflix’s Terms of Use No. 4.2, Netflix Household Policy, and Netflix Brand Assets Terms & Conditions. Illegal Netflix account sellers have been found to commit breach of contract, unlawful acts, violations of the good faith principle, trademark passing off, unauthorized copyright distribution, and price manipulation in electronic transactions. This study concludes that Indonesia’s legal framework provides comprehensive instruments to protect Netflix from illegal account sales, though enforcement still requires improvement.
