Abstract

This study examines the legal protection of Communal Intellectual Property (CIP) belonging to indigenous communities and its enforcement in the face of biopiracy. The rampant exploitation of traditional knowledge and genetic resources by foreign parties demonstrates the weakness of the legal protection system in Indonesia. The method used is normative legal research with a statutory approach. The results indicate that CIP protection is implemented in two forms: positive protection through regulations such as Government Regulation No. 56 of 2022, and defensive protection through official data collection at the National CIP Data Center. However, its implementation is still hampered by weak supervision, minimal awareness among indigenous communities, and a lack of coordination between institutions. Furthermore, the absence of specific legislation makes law enforcement against CIP violations less than optimal. Special regulations, increased capacity of law enforcement officials, and the implementation of a fair and transparent Access and Benefit Sharing (ABS) mechanism are needed to protect the rights of indigenous communities and safeguard the nation's cultural sovereignty.
