Abstract

This study aims to determine the consideration of the panel of judges on the suitability and fulfillment of the elements in Article 27 paragraph (3) of the ITE Law regarding the criminal act of defamation committed by journalists against the application of the Press Law in handling journalistic disputes, as well as the Islamic view of defamation in the study of the decision of the Palopo District Court Number 46/Pid.Sus/2019/Pn.Plp. This research uses a normative approach. The type of research is descriptive with primary and secondary legal sources. Data collection techniques were carried out by document and literature studies, and data analysis techniques using qualitative juridical analysis methods based on deductive logic. The results of this study show that the material actions of the defendant are in accordance with the elements contained in Article 27 paragraph (3) of the ITE Law on defamation. However, when reviewed through the Press Law, there is confusion over the mechanism for resolving journalistic disputes that should not be brought into the criminal realm. Therefore, it is necessary to re-establish issues regarding the settlement mechanism relating to the press and adjustments must be made between the Press Law and the ITE Law.
