Abstract

With the development of technology, it has many impacts on society. Advances in the internet bring various conveniences and progress that can be felt by people in various walks of life. One of the prominent changes is related to online trading activities. Online shopping is booming among the people. One industry that is developing due to online shopping habits is e-commerce. Shopee as the market leader in the e-commerce industry in Indonesia continues to make various innovations in an effort to maintain its position. Shopee holds a Partnership+ program where sellers who agree to become Partnership+ Sellers will get benefits related to promotion and marketing services. This research aims to find out the process partnership+ program cooperation agreement between PT. Shopee Internasional Indonesia with Partnership+ Sellers, applicable regulations rights and obligations between PT. Shopee Internasional Indonesia with Partnership+ Sellers, as well as responsibility if one party makes a mistake based on default and unlawful act. The approach method used is a normative approach that examines legal principles and legal principles regarding partnership + program cooperation agreements. The type of research used is descriptive research, namely by obtaining a clear picture of the implementation process, the rights and obligations of the parties and the responsibilities of the parties if there are defaults and unlawful acts in the cooperation program. The results of the research on the partnership+ program cooperation agreement stated that in the process and implementation of the partnership cooperation agreement, the administrative requirements and legal requirements contained in Article 1320 of the Civil Code must be met. Then the birth of the agreement occurred with the signing of a partnership cooperation agreement made by large businesses based on a standard agreement. The existence of an agreement creates a legal relationship that gives birth to rights and obligations for the parties. If one of the parties makes a mistake in the partnership agreement, because it does not fulfill its obligations, it must be responsible on the basis of default, whereas if it violates the applicable regulations, it must be responsible on the basis of an unlawful act.
