Abstract

The rapid development of technology has affected the digitalization process in all areas of life, including buying and selling transactions. Buying and selling activities can be carried out electronically, namely through an intermediary, namely the market place. Market place is an electronic trading medium that is used as a forum for business actors to offer their goods to consumers. The sale of non-original goods is one of the violations committed by business actors to gain more profit. The purpose of this writing is to find out how the market place is responsible for customer losses due to the rampant sale of non-original goods, to know more deeply about consumer protection against the rampant sale of non-original goods and the obstacles experienced by the market place in the process of implementing this accountability. The problem approach used in this study is normative juridical. Therefore research is needed as a basic plan as an effort to develop science. The data source for this research was obtained from secondary data. Secondary data is data obtained from the results of library research. The results of this study indicate that the market place has a responsibility for losses suffered by customers due to the rampant sale of non-original goods. One example of a market place is that Shopee has responsibilities in the form of purchase guarantees, refunds and the process of sending goods back from consumers to business actors. The market place also provides consumer protection in accordance with Law Number 8 of 1999 concerning consumer protection. In the implementation of accountability there are several obstacles that hinder market place such as limited control, lack of resources, technological limitations, competition and regulatory issues.
