Abstract

Trademark registration is an important thing to do in the business world so that business entities are protected by law so that their trade is not used by other parties. Brand owners get exclusive rights from the Trademark Registry, Marks and Geographical Indications Act to be able to use their own marks and allow others to use their own marks. According to the Marks and Geographical Indications Act, all marks can be registered except for two things, namely unregisterable marks and rejected marks. Case in point related to trademark registration of Citayam Fashion Week. This study aims to know and understand what stages must be passed for registration of rights to the Citayam Fashion Week brand and to know and understand the polemic of Citayam Fashion Week brand registration in terms of Indonesian law. The method used in this study is the normative juridical method, namely by studying, analyzing, inventorying and understanding the law as a set of regulations or positive norms in the system of laws and regulations that regulate human life. What are the requirements related to registration of Trademark Rights and What Factors cause Trademark Rights to be rejected? And how is the polemic of Citayam Fashion Week Brand Registration reviewed from the Law in Indonesia? The results of the research obtained are In the case of registration of the Citayam Fashion Week brand conducted by Baim Wong, the public did not approve it because Baim Wong took advantage of the Viral Citayam Fashion Week for his own sake and his own benefit, while those who made Citayam Fashion Week viral were themselves. Therefore, the Citayam Fashion Week brand is not allowed. In the case of A quo PT. Tiger Wong Entertainment and Indigo Aditya Nugroho as the parties who applied for trademark registration at Citayam Fashion Week are not promoters of the brand. This allows the trademark to be registered in bad faith. In addition, Citayam Fashion Week cannot be monopolized by a particular party but can be shared by the wider community.
