Abstract
The IPR legal protection system in Indonesia divides IPR ownership into two, namely private IPR and communal IPR. Copyright is a form of IPR protection. Law Number 28 of 2014 concerning Copyright stipulates that the acquisition of rights to a work is automatic (first to publish) while the protection of communal IPR in the form of TCE is owned by the State. The purpose of this study was to determine the legal protection of traditional dances in Magetan Regency in the IPR system and to find out what obstacles were in registering traditional dances in Magetan Regency. This research method is empirical with descriptive research type. The results of the research show that the traditional dance art belonging to an individual whose creator is known has automatic protection, but it is better if the right is registered as initial evidence of copyright ownership. Obstacles to legal protection of Copyright for Traditional Dances in Magetan Regency are due to several things, namely: 1). The absence of an active role from local government; 2). The recording process is complicated and requires a fee; 3). A sense of mutual cooperation and mutual assistance between artists 4). Doubts over the originality of the dance created. The ownership of the dance art whose creator is unknown is held by the state, therefore the state is obliged to take an inventory, maintain, and maintain Traditional Cultural Expressions (TCE). Currently there is no inventory carried out by the Regional Government on Doger Dance as an TCE owned by the Magetan community. This is because the lack of knowledge about Copyright (and IPR in general) is a factor that affects the protection of works of art. This lack of knowledge about Copyright is also a result of the passive nature of the Ministry of Law and Human Rights.
