Abstract
The placement fee cannot be charged to Indonesian migrant workers as described in Article 30 paragraph (1) of Law No. 18 of 2017. For this reason, Article 30 paragraph (2) of the regulation mandates BP2MI to make Agency Regulations regarding placement fees. Based on the mandate of the article, BP2MI made BP2MI Regulation No. 09 of 2020 concerning Exemption of Indonesian Migrant Worker Placement Fees. One of the contents of the regulation is that it only stipulates 10 types of positions for Indonesian migrant workers who are entitled to get a placement fee waiver, while in reality there are many other types of positions for Indonesian migrant workers that have the potential to be exempted from placement fees. By using normative legal research that is descriptive in nature and then analyzed using qualitative methods supported by deductive reasoning methods, the results obtained are that the BP2MI policy which only stipulates 10 types of positions for Indonesian migrant workers whose placement fees are freed is not in accordance with the concept of the welfare state adopted by the Indonesian state, because the concept emphasizes equitable justice for all its people. In addition, if it is associated with several principles of protection for Indonesian migrant workers, including the principle of social justice, the principle of non-discrimination, the principle of anti-trafficking, and the principle of democracy, the criteria for the position of Indonesian migrant workers should also be exempted from placement fees outside the 10 types of positions migrant workers as referred to in BP2MI Regulation No. 09 of 2020, among others, are vulnerable to discrimination, exploitation, violence, human trafficking practices, as well as threats of opinion and restrictions on access to movement.
