Abstract
In the current era of industrialization, development and the economy in Indonesia are increasing. Therefore, the government held one program, namely the construction of village shop houses to support the economy of the villagers. Village-owned shophouses are usually built on village treasury land. This study aims to determine the process of renting a shop-house rental agreement with an auction system in the villages of Kingkang, Wonosari, Klaten and legal responsibility in the event of a default in the village-owned shophouse rental agreement from a Civil Law perspective.The approach method used in this research is a normative doctrinal approach, because this research will examine the legal rules, legal principles, and legal aspects related to the renting of village-owned shophouses with an auction system. The type of research used is descriptive research. The results of this study indicate that the process of renting a shop-house rental agreement belonging to the village of Kingkang with an auction system begins with an announcement followed by registration of the auction, then the auction participants carry out the auction according to the time and regulations that have been determined. The auction winner has the right to rent the shop. The auction process for the shophouse owned by the village of Kingkang has been carried out in accordance with the auction procedures and rules. The process of renting a shophouse owned by the village of Kingkang has also complied with the provisions of the lease agreement. The form of legal responsibility if there is a default in the rental agreement for the shophouse owned by the village of Kingkang which is the object of the agreement, that is, the settlement is prioritized by family or deliberation, and can be sued for compensation in the form of cancellation of the agreement, the money that has been entered cannot be requested back. The parties to the rental agreement for the shophouse owned by Kingkang Village have carried out their rights and obligations according to the provisions of the agreement. During the implementation of the rental agreement for the shophouses owned by the village of Kingkang there has never been a case of default, but the agreement for the lease of the shop houses owned by the village of Kingkang has regulated the provisions in the event of a default between the two parties in the agreement.
