Abstract

Procurement of work agreements creates a bond that requires both parties to give each other achievements. The agreement can be said to be valid if the conditions written in Article 1320 of the Civil Code are fulfilled. In order to guarantee the basic rights of workers, guaranteed employment opportunities and fair treatment without discrimination, then this Specific Time Work Agreement or in Indonesian is called PKWT, should include all rights and legal protections for workers. This research uses a juridical-normative. The data that is used is secondary data which are processed using deductive logic. This study examines whether this agreement is in accordance with the applicable regulations in Indonesia and whether the protection aspect for workers has been fulfilled. PKWT of PT. Gudang Garam Tbk. that located in Kediri has complied with Article 1320 of the Civil Code and Article 54 paragraph (1) of Law Number 13 of 2003 concerning Manpower. Aspects of protection for workers are still lacking so that this agreement does not reflect legal certainty.
