Abstract
The main problem in this study is that renting is one of the economic activities that is allowed under Islamic law. One example of the practice of renting at Nisa Decoration & Bridal Makeup is by using a down payment. Where in the lease, the owner of the rental takes advantage of the advance that has been paid and does not return it in the event of a cancellation of the lease made by the tenant. The purpose of this study is to find out the process / mechanism for renting wedding party decoration equipment using an advance and how Islamic law reviews the use of advances by business owners due to cancellation of the rental of wedding party decoration equipment at the Nisa Decoration & Bridal Makeup rental place. The research method used is qualitative with the type of field research (field research) taken by interviewing the owner or the owner of Nisa Decor & Bridal Makeup and documentation at the time of conducting interviews. The researcher uses the inductive analysis method, namely by drawing conclusions about all concrete events or facts in the use of advances by business owners after the termination of the lease. The results of the study explain that the rental process at Nisa Decor & Bridal Makeup is that both parties have agreed to enter into an agreement before the transaction is carried out and require the tenant (musta'jir) to pay an earlier amount of money to the party who rents out (mu'jir), the money will be combined into the payment and if the lease is cancelled, the advance that has been paid becomes the property of the lessor. Leasing with a down payment system ('urbun) if the party who rents out (mu'jir) does not return the down payment to the tenant (musta'jir) and takes advantage of the down payment due to the cancellation of the lease, which is not allowed, because it includes consuming other people's property illegally. vanity. According to Islamic law, in a lease transaction by giving an advance to the party who rents out, if the tenant cancels the order or does not order, the advance must be returned as explained in Q.S An-Nisa' Paragraph 29.
