Abstract
The development of sophisticated technology, information and communication facilitates every human activity in all fields. One of the online service providers in Indonesia is Go-Jek. Go-Jek as a transportation application provider company functions as a liaison with service providers in this case is a motorcycle taxi driver/driver. Go-Jek's business activity is to run and develop an application technology which is then used to connect service providers and service users. The purpose of this study was to determine the process of agreement, regulations and rights and obligations in the agreement between PT. Go-Jek Indonesia, Go-Jek drivers with passengers, as well as legal liability if one party defaults or violates the law. This type of research is descriptive research, because it aims to provide a comprehensive and systematic description of the legal responsibilities of PT. Go-Jek Indonesia for the implementation of the agreement between the driver and the passenger and the legal responsibility for the implementation of the Go-Jek agreement between the driver and the passenger. With a normative approach, because in this study what was studied were the principles of law, the rule of law relating to the agreement between PT. Go-Jek Indonesia, Go-Jek drivers with passengers and legal responsibility for the implementation of Go-Jek agreements between drivers and passengers. The results showed that there were three stages in the agreement process between PT. Go-Jek Indonesia, Go-Jek drivers with passengers, namely the stage of administrative requirements that must be prepared before an agreement occurs, the stage when an agreement occurs, the driver agrees to the agreement by clicking on the agreement letter that has been prepared by PT. Go-Jek Indonesia, and the stage after the agreement was reached, there was a legal relationship between PT. Go-Jek Indonesia with partners (drivers and passengers). The legal relationship after an agreement creates rights and obligations for the parties according to their respective parts. In carrying out the rights and obligations must comply with the rules. If one of the parties does not fulfill the rights and obligations, it can be accounted for based on default as stated in Article 1243 of the Civil Code. If one party violates the applicable laws and regulations, it can be accounted for based on unlawful acts as regulated in Article 1365 of the Civil Code.
