Abstract
As technology advances, online business has become a part of people's lives. In practice, the online business is not infrequently default, default in general can be interpreted as non-fulfillment of achievements in the agreement, achievements that are not in accordance with what was promised, and fulfillment of achievements but late. In online buying and selling transactions, for example, the goods ordered do not match the order or the goods are not delivered. But what happens in the legal certainty community regarding this is still confusion. In several cases, many parties feel that they have been harmed, but the losses they have experienced are only published on social media without knowing how the legal process is going. The purpose of this study is to provide information about the legal regulation of default in the community through online buying and selling and to provide knowledge about the legal consequences if there is a default in online buying and selling. The research method used is a qualitative method approach, meaning that finding problems is carried out by written interviews by distributing questionnaires to respondents and the type of descriptive research aims to determine the legal arrangement of online buying and selling defaults from the perspective of the Civil Code and consumer protection of the occurrence of default. The results of this study indicate that the respondents who filled out the questionnaire were 17 people, 15 of whom experienced default when they made online buying and selling transactions and they did not know the legal consequences if there was a default. Default is regulated in articles 1238, 1239, 1243, 1247, 1248 and 1250 in the Civil Code. If there is a default, the creditor can ask for compensation from the debtor in accordance with applicable regulations.
