Abstract

This study aims to find out about the police's discretion in implementing SP3 in resolving accidents involving families in the jurisdiction of the Surakarta Police. This study uses an empirical juridical method with the main data source being primary data in the form of interviews with parties related to the case in the formulation of the problem, in addition to using secondary data in the form of books and journals. This study uses a descriptive analytical approach, data collection techniques are carried out by means of a literature study, as well as interviews with members of the Laka Traffic Unit of the Surakarta Police, advocates, and the suspect's family to know police discretion in the release of SP3 on the resolution of traffic accidents involving families in the jurisdiction. Data analysis was carried out by examining the data obtained and then described in the form of a narrative so that an explanation of the problems in this study was obtained. From this study, it was found that the police's discretion in issuing SP3 is based on the Circular Letter of the Chief of Police Number SE/8/VII/2018 concerning the Application of Restorative Justice and considers aspects of justice, benefit, and social humanity by taking into account certain limitations. Barriers to the community in the application of police discretion, namely laws and regulations, difficulty in obtaining evidence, the assumption that there is a lack of public understanding of the police. Police discretion in Islam is called ijtihad.
