Abstract
The independence of the judiciary is the most fundamental feature of every democratic rule of law. The existence of an independent court consists of 3 (three) reasons, namely; a) the court is the guardian of the constitution; b) free courts are elements of a democratic state; c) the court is the root of the rule of law. The purpose of law is not only justice, but also legal certainty and expediency. Ideally the law should accommodate all three. Apart from all longing for other things which are also the goal of law, order as the main goal of law is an objective fact that applies to all human societies in all their forms. The role of law in development is to ensure that change occurs in an orderly manner because both change and order (order) are twin goals of a developing society, thus becoming a tool that cannot be ignored in the development process
