Abstract

The Constitution and the State always coexist closely and cannot be separated, Indonesia is a nation-a nation that adheres to religion, a country that implements the teachings of religion as a moral, and also as a source of material law in the implementation of national and state life. Therefore, this is clearly stated in the first principle of Pancasila which reads "Belief in One Supreme God. The constitution is always related to the notion of constitutionalism which in its basic sense is an agreement (consensus) between the majority of citizens regarding the building to be ratified with regard to the state. There has been a long debate about the relationship between Islam and politics that fills the national political scene. The description of the relationship between religion and politics shows the old paradigm that seeks to isolate religion from the political sphere which is directly bankrupt, then how is the actual implementation in the constitution of Muslims as experts explain that Indonesia with the basis of Pancasila and the 1945 Constitution is an Islamic country. The approach method used in this study is a normative-empirical legal research method where this method basically combines a normative legal approach with the addition of empirical elements it. The type of research that the author uses in this study is descriptive qualitative research.
