Abstract

Obscenity is an act that is indecent in the sexual field, such as the act of groping the genitals which is carried out in public that causes lustful stimulation. Victims of sexual abuse are often children because they are powerless and used by perpetrators for sexual stimulation, resulting in the child's psychological condition and other developments being disrupted. So there is a need for legal protection that regulates it. The crime of sexual abuse against children adheres to the principle of lex specialis derogat lex generalis. The juvenile criminal justice system as the perpetrator seeks to resolve cases in a specially regulated diversionary manner. All kinds of acts of discrimination or other forms of human rights violations should not be ignored, they can be carried out through international human rights instruments and national legal instruments. In Islamic criminal law, sexual immorality must be subject to a criminal law (jarimah) which is rewarded with a ta'zir penalty because there is no explicit sanction provision in the Qur'an and Hadith. Writing using the research method used is a juridical-normative research method by examining library materials or secondary data by conducting a search on regulations and literature.
