Abstract
The work agreement is specifically regulated in Law Number 13 of 2003. According to Article 1601a of the Civil Code, what is meant by a work agreement is an agreement in which one party, the worker, binds himself to work for the other party, the employer, for a certain period of time, by receiving wages. This study aims to determine the work agreement process between PT. SARI WARNA ASLI with workers in carrying out work, knowing the rules and rights and obligations between PT. SARI WARNA ASLIwith workers in doing work and knowing the legal responsibility of a party making a mistake in running the company. This study uses a normative method approach because in this study, what is studied is the legal principles or legal regulations in the work agreement that is carried out between the company and the workers along with their legal responsibilities. This type of research is descriptive, because in the research the researcher will describe and explain what it is about the work agreement. Regarding the legal responsibility between companies and workers in doing work at PT. SARI WARNA ASLI. The result of the research shows that work agreement process by providing a letter showing a ib application to the company, carrying out a written test and an interview test it is stated that a prospective worker who promise to work after agreeing that the worker can already do the job, the right of the company to get maximum work result from the employee the company’s obligation to provide wages that comply with the law Invitating and in accordance with the work agreement,the right of worker object if the worker security requirement are not fulfied, the workes’ obligation to fulfill and comply with the requirements of the workplace and the regulation for work and thr trgulation for work come to work according to company working hours , the right and obligations of parties and the work regulation if there is an erorr between the two parties resolve the problem by deliberation and both parties agree. If one of the parties still feel aggrieved, he can file a lawsuit against the Industrial Court based on default and act against the law to compensate for losses, if at the hearing he is proven guilty then he must compensate for the loss based in the judges decision.
