Abstract

The purpose of this research is to describe the understanding of society how the position and rights of each heir in the distribution of inheritance according to Islamic and western inheritance law. The method used is a normative juridical approach through a descriptive approach. Types and sources of data consist of primary and secondary data. The data collection method is through literature study. then analyzed by qualitative analysis methods. The results showed that the position of the heir was a biological child from a second marriage so that the heir had a position to inherit and had the right to get an equal share.
