Abstract

This research is about the molestation commited by a minor named Andrian Dimas Saputra a.k.a Andri Budiman’s son (17 Years Old) to testifier Mella Kharisma (13 Years Old). Andrian Dimas Saputra Budiman’s son has been convicted of violating and criminal penalties under article 81 of chapter (2) the number 35 year 2014 law on changing to the number 23 year 2002 law on child protection of Jo. Article 1 of article 3 law number 11 year 2012 on the child’s justice system in this case judges must consider the criminal to be charged, as the perpetrator is a child with a future and successor to the nation. The practice of rape committed by perpetration in Islamic law is an act of adultery and must be flogged or flogged 100 times and exiled for one year
