Abstract

The process of carrying out the labor process can be done in two ways, namely normal delivery and delivery of a cesarean section, in the implementation of the delivery process, especially cesarean section delivery, of course, will create a relationship between the doctor and the patient, the doctor and patient agreement occurs when the patient signs a medical agreement. which was held by the doctor of PKU Aisyiyah Boyolali Hospital after signing, there was an agreement between the doctor and the patient, at that time the doctor could carry out medical actions for cesarean section. This study aims to find out how the process of implementing a cesarean section between the doctor and the patient, knowing how the regulations are. rights and obligations that arise in the implementation of a cesarean section as well as knowing the legal responsibility if one makes a mistake in the implementation of a cesarean section. This study uses the Normative Approach Method, because this study examines legal regulations and legal principles in the implementation of cesarean section. The type of research used in this research is a descriptive study which provides a comprehensive and systematic description of the legal responsibility between doctors and patients in the implementation of a caesarean section. The results showed that in the process of implementing cesarean section, administrative requirements, legal requirements, screening, observation, informed consent. Then the patient or the family gives consent by signing a letter of approval for a cesarean surgery medical procedure, with the consent given by the patient or the patient, a c-section can be performed. With the agreement between the doctor and the patient, it creates a legal relationship, this legal relationship creates rights and obligations that must be fulfilled by each party, if one of the parties makes a mistake in the caesarean section, then the party found to have made a mistake must be responsible on the basis of defaults and acts against the law.
