Abstract

Merging claims for compensation which are generally civil in nature then combined with criminal cases is a new thing in the law enforcement process in the Republic of Indonesian. The criminal procedure contains legal rights and procedures that can be taken by victim of criminal acts who have suffered losses so that they can claims for compensation in the ongoing criminal case process so that the judiciary can run quickly, simply, and low cost. The purpose of this research is to find out what forms of legal protection and consideration of the case review panel in the compensation suit merger. The type of research that the writer uses is descriptive research which will describe as completely as possible the merger of claims for compensation by the criminal procedure. The results of this study indicate that the process of merging claims for compensation due to criminal acts can make it easier for victims who have been injured to regain their rights, it should be noted that although there are laws that regulate and aim to facilitate the judicial process for victim of crime, however there are other factors that hinder the examination of the merger compensation claims, including the examination of material losses submitted by the victim, on average the case review panel will be rejected because according to the panel’s consideration, this case does not include actual losses suffered by victim of criminal acts.
