Abstract

The title of this research is Analysis of the Legality of Bitcoin as a Virtual Currency. The objectives of this study are as follows: a) to determine the perspective of state law and Islam on commodity buying and selling transactions using bitcoin; b) to determine the legal position of bitcoin as virtual currency. The approach method used in this research is the normative method. The type of research used is descriptive, which is to clearly describe the legality of Bitcoin as a virtual currency. The results of the research obtained are users or consumers who do not use the legal currency of Indonesia, one of which is the currency, namely Rupiah in transactions, so they can be subject to Article 33 of Bank Indonesia Regulation (PBI) number 18/40 / PBI / 2016 concerning the Implementation of Payment Transaction Processing which explains everyone who does not use Rupiah. Bitcoin business transactions are not in accordance with the DSN-MUI Number 28 / DSN-MUI / III / 2002 concerning Currency Buying and Selling (Sharf). Decree of the Fatwa of the National Sharia Council-Indonesian Ulema Council No: 116 / DSN-MUI / IX / 20I7 Regarding Sharia Electronic Money, Q.S Al Maidah paragraph 1 is stated: “… you who believe! Fulfill the contracts… "Given that in Islam related to contract issues, this is also related to the problem of the concept of profit taking. MUI DSN Fatwa No: 116 / DSNMUI / IX / 20I7 Regarding Islamic Electronic Money, Part Three Article 1 which states: "The contract between the issuer and the holder of electronic money is the wadi'ah contract or the qardh contract." With the use of a wadiah contract between the bank and the customer, the bank as the deposited party (wadi'i) is entitled to a fee from custodian services performed by the customer as the depositor (Mudi).
