Abstract

The divorce mechanism in the Divorce Marriage Law can only be done before a court session. This is in accordance with the principles contained in the marriage law number 4 letter e because the purpose of marriage is to form a family that is eternal and prosperous, then 2) According to Islamic law, divorce through online media is either only a voice or accompanied by the form of a communicating party in the form of a picture (video call). So according to the Shari'a the talak is declared as legal talak, even though there is no guardian and it is not delivered directly in front of the wife. While talak through online media, the majority of scholars emphasized that talak through online media is legal, because talak through online media can be practiced with talak through written letters. According to positive law, it is in line with the provisions in Islamic legal law which regulates talak, namely the provisions in KHI derived from Islamic law.
