Abstract

Introduction: Contemporary financial transactions have developed along with the times. Contemporary financial transactions give birth to various types of the modern contract as well as a variety of contract patterns that have emerged that are in line with the needs of society. One of the important ways by which a person achieves his goals in financial transactions is the practice of hilah. Purpose: The purpose of this research is to deeply understand hilah laws. This study also explains how it is applied in several contemporary financial transactions by paying attention to the rules according to the sharia. Method: This research uses an analytical study method by understanding Islamic Fiqh about the practice of hilah with its application in contemporary financial transactions by tracking and analyzing the books of both past and contemporary Ulema as well as academic studies in the form of scientific papers and articles. Results and Discussion: It is impossible to say that all hilah practices are forbidden, but it also cannot be said that all hilah practices are allowed. The results showed that contemporary financial transactions carried out by some people sometimes contain contracts that are prohibited, such as contracts of riba. They practice hilah with the intention of avoiding riba as they believe, but in fact, what they are implementing is actually forbidden contracts which should have been avoided.
