Abstract

High consumption power in society triggers an increase in the amount of demand for a product, this causes many large companies to sell their products in the form of franchises in order to reach a wider market, but not only large companies sell their products in the form of franchises, many are also found. Micro, small and medium enterprises try to sell their products in the form of a franchise, this raises many questions about the feasibility of the system, management and legal protection of these products, lack of knowledge and legal literacy causes uncertainty about these products, as stated in Government Regulation No. 42 of 2007 concerning Franchising, that a franchise must have special requirements to be called a franchise, namely; special characteristics, proven profitable, have guaranteed standards, continuous support, easy to teach, registered as intellectual property rights, in the explanation above which is the background of this thesis writing. In writing the thesis entitled "Analysis of the non-license franchise agreement (Case Study of Nolandfood Surakarta), the author uses data collection methods, from interviews with Nolandfood owners themselves and collecting data from literature studies from various books, websites and direct research to institutions authorized for recording. The franchise agreement, namely the Department of Industry and Manpower of Sukoharjo Regency, is included in the type of qualitative field (field research) and is descriptive and analytical in nature, what is meant here is that research describes the state of an event in detail about the Nolandfood franchise process, research is legal sociological research or normative -empirical, by examining a system through an approach to the parties concerned, with the intention of identifying and clarifying a problem by referring to the problem formulation that has been put forward by the author. On the basis of the stated background, the author tries to explain the systematics and implementation of the franchise agreement by detailing the prison terms to explain the contents of the object and the role of the subject in the franchise agreement de jure or based on the applicable laws and regulations to be compared with the franchise agreement which is the subject of writing. thesis, namely the franchise agreement made by Nolandfood or de facto, from the results of the comparison can be found an answer to the formulation of the problem, namely, what is the form, legal strength, legal consequences of the franchise agreement made by Nolandfood, which can then be used as a guide or the basis of society to consider the decision before buying and signing a franchise agreement to ensure legal certainty for legal protection should a dispute arise
