Abstract

This letter seeks the mandate in marriage to study a comparison between the madzhab Syafi’i and the set of proposals for Islamic provisions (KHI) especially in the reasons for proving the mandate in marriage, when the mandate is transferred to the Sultan, and what are the conditions of the guardian until his mandate is correct, and the order of the saints when they meet. His conclusion is that there is agreement and disagreement between the two sides. One aspect of the agreement between them is the order of the guardians of the lineage when they meet, and the fact that the mandate is fixed in proportions and authority. One of the differences is that loyalty is the reason for the establishment of the mandate, and in the conditions of the guardian, islam, masculinity, puberty and reason are mentioned, and more overthe four other madzhab Syafi’i are freedom, majority, solution and non-debauchery, as well as the fact that the deaf and dumb are old, as the adopted in the madzhab Syafi’I is not prohibited from the mandate other than what was decided in the KHI.
