Abstract

Introduction: One of the innovations in muamalah fiqh is in banking services in Indonesia, especially Islamic banking. An example of a new contract is the practice of many contracts in one type of contract. Sometimes it consists of one contract with the practice of hilah (getting around the law of fiqh), and sometimes 2 contracts at once, or even 3 contracts in one agreement. Purpose: This research has several objectives. In addition to deeply understanding hilah, this study also aims to open the horizons of bank customers so they don't use contracts that are not in accordance with Islamic teachings. Method: This is a qualitative research with a critical discourse analysis method. Data is collected from books, news, and journals. This study conducted interviews with Islamic bank employees to obtain more precise findings and conclusions. Result and Discusion: Islamic banks use multi-contracted practice in their services with hilah. The practice of hilah here is used to achieve the goals desired by Islamic banks, as well as an effort to be free from riba practices, according to them. Islamic banks use hilah, which can be categorized as “halal” as long as the bank sticks closely to the existing provisions, but there are also hilah that are almost the same as riba.
