Abstract

The issue of transgender is very widespread in people's lives today with sex-change operations for the sake of being a real man or woman. This is still considered taboo, because it is considered to violate the nature and contrary to the values of the Islamic religion, Islam only regulates the distribution of inheritance for men and women does not apply inheritance for transvestites. This study aims to describe the position of transgender and to examine the allocation of transgender in inheritance according to Islamic law. This type of research is library research used is a method that uses normative data merging techniques through library research and try with qualitative methods. The results of this study indicate that the position of the transgender heir in Islamic law will be in accordance with the sex before he performs operations performed without disabilities, in contrast to transgender which causes differences in disability in him will be in accordance with medical results. The determination of the inheritance for transgender is done by determining the sex of the transgender, to determine the sex of a transgender can be done using medical results or by using the original sex before performing surgery.
