Abstract

This thesis discusses the comparison of the opinions of the Ulama of the Four Schools with the laws in Indonesia regarding the groups entitled to receive zakat. The Prophet sallallaahu 'alaihi wa sallam specifies the mention of the poor in some of his hadiths, which shows that they are the most entitled to receive zakat and should take precedence over others. Therefore, Indonesia has made poverty alleviation the main objective in zakat management activities by issuing laws. However, after examining the words of the ulama of the Four Madzhab, then comparing them with the law, the authors found several differences which had quite an impact on the realization of the country's goals. What are some of the differences? What is the impact of these differences on religious law that affect the realization of the country's goals? So the purpose of writing this thesis is to find out these differences and reveal their impact on religious law which affects the realization of the country's goals. In writing this thesis the writer uses library research and comparison methods. Namely by reading the books of the scholars of the Four Schools and examining their opinions regarding groups entitled to receive zakat, then comparing them with the applicable laws and regulations. In conclusion, these differences actually return to one main point, namely that the law tends to broaden the understanding of the arguments for zakat mustahik based on the generality of pronunciation. Meanwhile, the ulama of the Four Schools tend to narrow it down by understanding pronunciation in accordance with the meaning of the Shari'a when revelation is revealed, and sometimes by requiring several requirements that are not required by law. One of the main effects of this difference is that according to the law it is permissible to distribute zakat for the construction of mosques, madrasas, and social institutions and da'wah. Meanwhile, according to the scholars of the Four Schools, this is not allowed. The impact of these differences in religious law greatly affects the realization of the goals of the state, in which the views of the Ulama of the Four Madzhab are felt to be faster in realizing the goals of the state compared to the views of the law. And this is more in line with the main objective of the Shari'a in this zakat activity, which is to help the needs of the poor. Keywords: Mustahik Zakat, Four Schools, Poor People.
