Abstract

Negligence is a form of crime, the crime of negligence generally occurs because the perpetrator is not careful and negligent. This negligence can occur in all forms of activities including in traffic life. When a person is negligent or negligent, causing an accident to occur, then that person by the public prosecutor can be charged with traffic negligence. Law Number 22 of 2009 concerning Road Traffic and Transportation, which in this case acts as a lex specialis to regulate traffic, can be used as a basis for ensnaring perpetrators. The regulation regarding negligence in the law lies in Article 229 paragraph (2) and the criminal provisions which are located in Article 310. Traffic accidents due to negligence certainly cause victims, both minor injuries, serious injuries and even death of a person. Therefore, the judge can issue a criminal verdict on the basis of the negligence of the defendant, because in fact the negligence in the traffic that causes traffic accidents that cause victims can be used as a legal basis by the public prosecutor to ensnare the perpetrator and impose a criminal verdict by the judge.
