Abstract

This thesis is an attempt to describe the pawn contract on the cornfield that happened in the Natam Baru Village, Badar, Southeast Aceh. This research is interesting to do because of the use of pawn guarantee item (marhun) by the pawn recipient (murtahin). And will focus in the issue of how the pawn contract and how the review of the National Sharia Boardl Fatwa (DSN) about the pawn contract. The purpose of this research was to know the pawn contract of the cornfield that was implemented by the community in Natam Baru Village, Badar, Southeast Aceh was in adjusted with the pawning contract rules in the Fatwa of the National Sharia Board or not. This research is a field research and the date are obtained using observation and interview methods. Data analysis method uses qualitative data analysis techniques. Based on the research results, it can be concluded. First, the pawn contract done by pawnshop (rahin) and the pawn recipient (murtahin) has fulfilled the elements of pawning according to the shara law, both the pillars and the pawn contract terms, but in the practice there are often elements of the use of the pawn guarantee item (marhun) by the pawn recipient (murtahin). Secondly, in the perspective of the Fatwa of the National Shara Board (DSN) on the pawn contract for cornfield in the community of Natam Baru Village, Badar, Southeast Aceh is illegal, because to the element of the use of the pawn guarantee item (marhun) by murtahin.
