Abstract

The number of companies that apply Sharia-based Multi Level Marketing (MLM) have grown rapidly. The MLM business model is one of the direct selling methods that uses the multilevel products and services marketing with marketing fee as the reward. There are many Sharia-based MLM businesses with uncertain legality and also the uncertain halalness of their product and business system. As a solution, PT. Herba Penawar Alwahida Indonesia applies the Sharia-based MLM to help people avoid the fraud in this business and do it based on Sharia. This research aims to determine Sharia-based MLM of HPAI agency based on the Fatwa DSN MUI No.75/DSN-MUI/VII/2019. This research is a qualitative research that uses techiques of collecting data such as field research, library research, interview and documentary study. The result of this study shows that based on Fatwa DSN MUI No.75/DSN-MUI/VII/2019, Sharia-based MLM applied in PT Herba Penawar Alwahida Indonesia agency system has not completely fulfilled the rule of law in DSN MUI’s fatwa due to a violation. It is about the lack of guidance to the downline. One of the factors that makes this violation happen is the upline’s excuse where they always justify their action that they do not guide the downline, so it influences other upline to do such violation.
