Abstract

Penal mediation is an alternative settlement of criminal cases conducted outside the court. The application of penal mediation emphasizes the restorative justice approach, which is carried out between the victim and the perpetrators of criminal acts or their families with the aim of recovery. As an effort to apply penal mediation, placing the police as investigators in the criminal justice system as the frontline, including in settling traffic accidents. One example as the case study of this research, Surakarta City Police Department applies penal mediation as an alternative solution to the past accident case cross mainly for the classification of mild and moderate, but sometimes it can resolve cases of accident classification of origin only in the form of material losses and injuries. In the case of a traffic accident that results in the death of a victim, then it remains with the criminal route. Islamic law has also regulated sanctions in the form of ta'zir jarimah and diyat. So basically the religion of Islam also suggests the existence of a peace as the settlement of the case with Restorative Justice.
