Abstract
The objectives of this study are: a) to find out the role of police investigators in implementing Restorative Justice in traffic accidents in Boyolali; b) to find out the factors used to resolve traffic accidents with the Restorative Justice approach in Boyolali; c) to find out the obstacles in implementing Restorative Justice in the field. The approach method used in this research is empirical juridical. This type of research is descriptive research that aims to describe accurately the characteristics of an individual, a particular condition, symptoms or groups, or to determine the spread of a symptom, or to determine whether there is a relationship between a symptom and other symptoms in society. The results of this study are the application of Restorative Justice saw from the Circular of the National Police Chief Number 8 / VII / 2018 on the Implementation of Restorative Justice which has fulfilled the material and formal requirements. With the fulfillment of all material and formal requirements in the National Police Circular No. 8 / VII / 2018 regarding the Implementation of Restorative Justice, the Police Investigator will stop the case due to the existence of a joint attachment letter signed by the parties involved. Traffic accident cases that can be resolved using Restorative Justice must meet the following requirements or criteria: a) Do not cause public unrest; b) Does not impact social conflict; c) Both parties have a statement of peace or agreement that the case is settled with family and relinquish the prosecute right before the law; d) The subject is not a repeated offender; e) The subject’s gults is not on purpose. Those requirements are based on Circular of the National Police Chief Number 8/VII/2018 on the Implementation of Restorative Justice and also the Article 12 Kapolri Regulation Number 6 Year 2019 concerning Criminal Investigation. The case of a traffic accident that is resolved by using Restorative Justice means that it cannot be continued anymore, because with the use of the Restorative Justice, the problems that have occurred have been considered to have been completed and there are no demands from the parties that litigate. Police investigators in implementing Restorative Justice in the field there are no significant obstacles, but the community lacks understanding regarding the existence of the settlement of traffic accident cases that can be resolved through the Restorative Justice approach.
